User: any person who visits and/or interacts with the Site.
Website: the online shop hosted at www.jeaninarat.com, through which the User/Buyer has access to information on the Products offered for sale by the Seller.
Products: the goods and services made available to the Buyer for sale through the Site, including those mentioned in the Order, to be supplied by the Seller to the Buyer following the conclusion of the Contract by placing the Order.

Buyer: any natural person, who has attained the age of 18 years, legal entity or any legal entity who places an Order in the online shop www.jeaninarat.com and who has accepted the Terms of this Remote Contract.
Contract: is the distance agreement concluded between JEANINARAT and the Buyer without their simultaneous physical presence. The contract of sale is concluded in Romanian or English, as appropriate.
Order: online communication between JEANINARAT and the Buyer, whereby the Buyer intends to purchase products from JEANINARAT, which the latter agrees to deliver and the Buyer agrees to pay for.
Account: the section of the Site consisting of an email address and password that allows the Buyer to submit the Order and contains information about User/Buyer, including his/her history on the Site. The User/Buyer is responsible for and will ensure that all information entered when creating the Account is correct, complete and up-to-date.
Shopping Cart: section of the Account that allows the User/Buyer to add Products they wish to purchase at the time of addition or at a later time.
By accessing and/or using jeaninarat.com, expressing any intention to purchase any Products and/or placing an Order, you ACCEPT the terms and conditions (the “Terms“) and all applicable laws, rules and regulations without exception. If you do not agree to, do not wish to fully comply with, or do not understand these Terms, please do not use this Site in any way, shape or form.
We reserve the right to change the content of the Site, including these Terms without prior notice to you. Modifications will apply for the future only, your Order will be subject to the Terms specified on jeaninarat.com at the time of placing and confirming your Order. If you do not agree to the changes, please stop using the Site.
The permitted purpose for using this Site is to obtain information and access to the Products and services offered by JEANINARAT. Any use for other purposes is not permitted.
They are not allowed and attract legal penalties:
– copying, duplicating, distributing, archiving or storing, by any means, including electronic, magnetic or computerized means, the materials and information on this Site;
– attempting to scan, probe or test the vulnerability of any system on the JEANINARAT network or accessing any servers or services on the JEANINARAT network that are not public without explicit written authorisation from JEANINARAT;
– performing or attempting to perform unauthorized operations on the Site (including, but not limited to: modification and/or deletion, misuse, fraudulent use, unauthorized access, copying information and/or Products for commercialization, blocking access, deliberately introducing viruses or any other program or material that may be technically harmful or destructive, etc.);
– using any email addresses published through the Site for distribution to mailing lists, for sending commercial emails (“spamming”) or for any other purpose than sending justified personal emails, without the written consent of the owners of these addresses. JEANINARAT reserves the right to immediately restrict access to the Site and terminate the Account of any User who violates these or any other provisions specified in these Terms. Where appropriate, JEANINARAT will report you to the competent authorities with a view to applying legal sanctions.
JEANINARAT makes every effort to present as accurately as possible the appearance, colour, characteristics and descriptions of the Products. These elements may be perceived differently in the images available on the Site than in reality due to various factors, including, but not limited to, the calibration of your screen. JEANINARAT shall not be held liable for any display errors that may occur, nor for any graphics displayed on JEANINARAT does not warrant that descriptions of Products or other related materials are accurate, complete, current or error-free.
By accepting the Terms, the Buyer understands and accepts that there may be differences between the actual Products and how they appear on the Site.
Products featured on this Site are available subject to availability. In the event of out of stock, the Order will be cancelled and the Buyer will be notified accordingly. For paid Orders, the countervalue will be refunded to the account from which the payment was made or to an account (IBAN) indicated by you (in the case of Cash on Delivery Orders).
JEANINARAT offers Custom Products upon request, provided that the resulting product is in accordance with the artist’s standards. The request can be communicated by email: contact@jeaninarat.com. JEANINARAT reserves the right to refuse Custom Orders for any reason.
JEANINARAT reserves the right to modify, suspend or terminate the online marketing of the Products at any time, in whole or in part, temporarily or permanently, with or without prior notice. JEANINARAT reserves the right to withdraw any Product from sale at any time.
The individual price of the Product is displayed in the Product details on the Product page and in the Shopping Cart. All prices for Products displayed on the Site are expressed in LEI (RON) and include value added tax (VAT). Prices do not include delivery tax or any additional fee for processing payment upon delivery. Their value can be consulted before placing the Order.
JEANINARAT reserves the right to freely adjust prices and special offers, in compliance with legal provisions and without prior notice.
In situations where prices and/or other details of Products have been incorrectly displayed, including due to Site malfunctions or human error, we reserve the right to cancel delivery of such Products. JEANINARAT will promptly inform the Buyer by telephone or email of the error if the Products have not been delivered by the time the error is reported.
JEANINARAT reserves the right, at certain times, to run promotions on certain Products, competitions with prizes or to offer price reductions or free shipping for Orders exceeding a certain amount set by us. At that time, these will be subject to Terms and Conditions or organisational regulations, additional to these Terms, which will be posted separately on the Site.
The Site can be accessed free of charge and simply browsing its pages is not conditional upon registration as a User. You can also make purchases without registering for a Customer Account by sending your Order to the following email address: contact@jeaninarat.com. However, in order to benefit from certain services offered by the Site, such as saving your address and billing information for future purchases, checking the status of your Orders, viewing the history of Orders placed, among others, you will need to register as a User.
The addition of a Product to the Shopping Cart, in the absence of the completion of the Order, does not entail the registration of the Order, nor the automatic reservation of the Product.
In order to buy through the Account you need to go through the following steps:
– Identification and choice of Products;
– Register as a User of www.jeaninarat.com;
– Adding the desired Products to your Shopping Cart;
– Filling in the data required to complete the Order;
– Placing the Order;
– Making the payment.
Registration of the Order does not constitute confirmation of the Order. Once the Order has been taken, it will be processed for confirmation and delivery details. The distance contract is deemed to be concluded between the parties when the Order placed by the Buyer is confirmed and accepted by the Seller. Before validating the Order and before dispatching the Products, JEANINARAT has the right to contact the Buyer, by any means available/agreeable to the parties, in order to obtain the Buyer’s personal confirmation of the Order or his/her identification details. The Buyer understands and accepts that the Seller cannot be forced to validate/deliver Products to persons who have not confirmed delivery and identification data. At the same time, to the extent that JEANINARAT will not resort to identity verification, the Buyer understands that it is fully responsible for the correctness of the data provided, and JEANINARAT is not liable for data incorrectly filled in by the Buyer in the event that the Products do not reach the Buyer. In the event of incorrect data being filled in when placing the Order, please contact us in good time at the email address: contact@jeaninarat.com.
Confirmation of the Order will be done by sending an email to the Buyer after payment is accepted.
JEANINARAT may cancel the Order placed by the Buyer, upon prior notice to the Buyer, without any further obligation of either party to the other, other than the refund of the payment made, if any, or without either party being entitled to claim damages from the other in the following cases:
– Non-acceptance by the Buyer’s card-issuing bank of the transaction in case of online payment;
– Invalidation of the transaction by the approved card processor in case of online payment;
– Data provided by the Buyer on the Site is incomplete and/or incorrect;
– The products are no longer in the Seller’s stock.
The Buyer has the possibility to modify or cancel the Order by sending a timely email to contact@jeaninarat.com. If the package is not yet prepared and/or shipped, we will take the necessary steps to complete or cancel the Order.
You can choose from the following payment methods to pay for the ordered Products:
– Online card;
– Bank transfer/payment order;
– Cash on delivery.
If you have chosen to pay by credit card, the Site will redirect you to a secure page where you will fill in a form with your credit card information.
If you have chosen bank transfer/payment order as your payment method, the following screen will thank you for your order and provide you with relevant information about your order and payment. You will also receive this information by email in the form of an invoice. Please make your payment as soon as possible and specify the order number you received by email in the “Payment details” section.
In the case of cash on delivery, after placing your Order you will receive by email the relevant information for your Order and the invoice for it, and you will then make payment for the Products to the person making the delivery. JEANINARAT reserves the right not to accept cash/cash on delivery for Products of large sizes and values (e.g. paintings larger than 50×50) for which the delivery cost is also higher. If you have a Product from this category in your Shopping Cart, you will not be able to select the cash on delivery payment method.
JEANINARAT shall not be liable for any and/or all existing or potential damages, direct or indirect, pecuniary or non-pecuniary, arising out of or in connection with the Card Payment Service Provider, and they shall bear full responsibility and liability for any and all such damages.
The Seller undertakes to deliver the Products via approved courier companies. The cost of shipment is specified prior to completion of the Order in each case (national or international delivery) and is the sole responsibility of the Buyer.
If you place your order before 12:00 noon and the ordered products are in stock, we will do our best to ship the same day, and if the delivery address is in a city in Romania, you will receive your order within 24-48h. During busy periods (holidays etc.), delivery can take up to 3-5 working days, depending on the courier’s schedule. For deliveries outside Romania, please note that transit time is longer and delivery can take up to 5-7 working days.
In case of cash/cash payment on delivery, the Buyer will take ownership of the Goods after signing the shipping document and making payment to the courier.
If the Buyer does not unjustifiably take over the Order, the Seller shall be entitled to claim compensation for the damage suffered.
It is not possible to collect the Orders personally from the Seller’s premises.
According to the legislation in force – Emergency Ordinance no. 34/2014 on consumer rights in contracts concluded with professionals, as well as for the amendment and completion of some normative acts (published in the Official Gazette, Part I no. 427 of 11.06.2014), the waiver of purchase/withdrawal from the Contract is applicable only to individual customers. Thus, the Buyer has the right to notify the Seller in writing that he/she renounces the purchase, without penalty and without giving any reason, within the legal term of 14 calendar days from the receipt of the Products.
Products can only be returned with prior notice to the Seller by email to: contact@jeaninarat.com. They must comply with our requirements and be eligible for return.
The costs of returning the Products will be borne by the Buyer. If the conditions are met, we will process your refund within 14 days of receipt of the Goods, to an account (IBAN) indicated by you (in the case of Cash on Delivery Orders) or via the online payment solution used (card refund). If you have not received your return, please inform us and/or contact your card issuing bank, as it may take 5-10 working days before the refund is processed. If you have done the above and still have not received your refund, please contact us at contact@jeaninarat.com
In the event of any discrepancies between the Products originally delivered, replacements or damage, or the Products are not delivered in the original packaging, are unopened, do not have the original labels, are missing the included accessories, the Seller may postpone the refund and refuse to accept the Products. The direct costs of returning the Products shall be borne by the Buyer.
Return conditions:
– It hasn’t been 14 days since you received your order;
– Products must be returned in their original packaging, unopened, with the original labels attached, with all accessories included and without signs of damage;
– The products will be returned in the original transport packaging (cardboard box, wooden box, collars, protective film, protective panels, as appropriate) and appropriately marked (e.g. FRAGIL);
– The products are accompanied by documents proving the purchase (invoice);
– The cost of transport will be borne by the Buyer;
– The seller was contacted in advance by email: contact@jeaninarat.com.
Products made to Buyer’s specifications or clearly customized to Buyer’s specifications are not eligible for return.
Attention! Please note that all shipping costs – initial as well as return – will be the responsibility of the Buyer. Cash on delivery parcels will not be accepted.
The cost of delivery shall be borne by the Buyer and payment shall be refunded ONLY by bank transfer. Return shipping labels are not provided by JEANINARAT and you will have to prepare the delivery and schedule a collection by the courier of your choice.
If you receive a Product from us that is damaged, please contact us by email at contact@jeaninarat.com. The return shipping fee is non-refundable unless we decide otherwise based on the information you provided as the reason for return, which will be reviewed on an individual basis.

JEANINARAT is the owner of all intellectual property rights on the online shop, namely on the trademarks, design, Site functionalities, images and technical specifications.
The content of the Site including, but not limited to, graphics, names, trademarks (such as, for example: the name of the Site and of JEANINARAT, symbols, images, texts, multimedia files) are the property of PINTILIE JEANINA AUTHORIZED PERSON and may not be taken and/or used without the prior written consent of the owner. The modification or use of the materials on this Site for purposes other than information, i.e. use as a customer, is strictly prohibited. JEANINARAT will take legal action if intellectual property rights and copyrights are infringed.
If JEANINARAT grants the User/Customer the right to use the content of the Site in a certain way, the User/Customer will use it only for the purpose for which it was defined and for a period defined in the agreement.
Any unauthorized modification of the Site is prohibited.
JEANINARAT undertakes to manage securely and only for the specified purposes, the personal data you provide us about yourself, therefore we will devote all necessary resources and efforts to process your data in full compliance with Regulation (EU) 2016/679 (“General Data Protection Regulation” or “GDPR”) as well as any other applicable legislation on Romanian territory. In the event of a dispute, an attempt will first be made to resolve the dispute amicably within 30 working days of receipt of the complaint by email: contact@jeaninarat.com. In the event that a settlement cannot be reached within the above-mentioned period, disputes between the parties will be settled by the competent Romanian courts.
